Agreement to these terms
These Terms of Service (“Terms”) apply to the Wandering Stars game for iPhone and iPad (the “App”) and this website (the “Site”), together the “Service”, provided by Wandering Stars (“we”, “us”). By downloading the App or using the Site you agree to these Terms. If you do not agree, please do not use the Service.
Your use of the App downloaded from the App Store is also governed by our End User License Agreement. How we handle information is described in our Privacy Policy.
Who may use the Service
Anyone may play Wandering Stars. If you are under the age of majority where you live, please use the Service with the permission of a parent or guardian, who accepts these Terms on your behalf.
A free game
The App is free. It contains no advertising, in-app purchases or subscriptions. We may add, change or remove levels and features over time, and nothing in these Terms promises that any particular feature will remain available.
Your license
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to use the App for your own non-commercial entertainment, and to view the Site. All rights not expressly granted are reserved by us.
Acceptable use
When using the Service, you agree not to:
- copy, modify, distribute, sell or rent the App or any part of it, except as the law expressly allows;
- decompile, reverse engineer or attempt to extract the App's source code, except to the extent applicable law permits despite this restriction;
- use the Service to break any law or to infringe anyone's rights;
- send us messages that are abusive, deceptive, malicious or that contain malware;
- interfere with or disrupt the Site or the systems that run it.
Messages, ideas and board codes
You keep ownership of anything you send us. If you send us feedback, ideas or suggestions, you allow us to use them to improve Wandering Stars without any obligation to you. Board codes you create are yours to share however you like.
Our intellectual property
The Service, including the game design, levels, creatures, character names, artwork, animation, interface, text and the Wandering Stars name and logo, is owned by us or our licensors and protected by intellectual property laws. Fonts and sound recordings used in the App are provided by third parties under their own licences, which are credited in the App and on the Site. These Terms do not give you any right to use our names, logos or trademarks.
Third-party services
The App is distributed by Apple through the App Store, and your use of the App Store is governed by Apple's terms. The Site loads files from third-party content delivery networks. We are not responsible for services we do not control.
Changes and availability
We may update, suspend or discontinue all or part of the Service at any time. Updates to the App may be required to keep playing. Because progress is stored on your device, deleting the App or resetting progress permanently removes it, and we cannot restore it.
Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error free or free of harmful components. Nothing in these Terms limits rights you have under consumer protection laws that cannot be excluded.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress or enjoyment, arising from your use of or inability to use the Service. Because the Service is free, our total liability for any claim relating to the Service is limited to the amount you paid us to use it, which is zero, or the minimum amount allowed by applicable law if greater. Some jurisdictions do not allow these limitations, so they may not apply to you in full.
Ending your use
You can stop using the Service at any time by deleting the App. We may suspend or end your right to use the Service if you seriously breach these Terms. Sections that by their nature should survive, such as ownership, disclaimers and limitation of liability, continue to apply.
Governing law
These Terms are governed by the laws that apply where Wandering Stars is established, without regard to conflict of law rules. This does not deprive you of the protection of mandatory laws of the country where you live, and you may bring a claim in the courts there where the law allows.
Changes to these Terms
We may update these Terms from time to time. The date at the top of the page shows when they last changed. If you keep using the Service after an update takes effect, you accept the updated Terms.
