Acknowledgement
This End User License Agreement (“EULA”) is a legal agreement between you and Wandering Stars (“we”, “us”) for the Wandering Stars application (the “Licensed Application”). It is concluded between you and Wandering Stars only, and not with Apple Inc. (“Apple”). Wandering Stars, not Apple, is solely responsible for the Licensed Application and its content. This EULA may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in effect on the date you accept it.
By downloading, installing or using the Licensed Application, you agree to this EULA. If you do not agree, do not download or use it.
Scope of license
We grant you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where available.
Restrictions
Except as expressly permitted by this EULA, the Usage Rules or applicable law, you may not copy, modify, translate, rent, lease, lend, sell, redistribute or sublicense the Licensed Application, or decompile, reverse engineer, disassemble or attempt to derive its source code or create derivative works from it.
Maintenance and support
Wandering Stars is solely responsible for providing any maintenance and support services for the Licensed Application, as described in this EULA or as required under applicable law. You and we acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. Warranty
Wandering Stars is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application to you. The Licensed Application is provided free of charge. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Wandering Stars.
To the maximum extent permitted by applicable law, the Licensed Application is provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded by law.
Product claims
You and we acknowledge that Wandering Stars, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
Intellectual property rights
You and we acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Wandering Stars, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms of agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, you must not be in violation of your wireless data service agreement when using it. The Licensed Application does not require an internet connection to play.
Termination
This EULA is effective until terminated by you or us. Your rights under it end automatically, without notice, if you fail to comply with any of its terms. Upon termination you must stop using the Licensed Application and delete all copies of it.
Limitation of liability
To the extent not prohibited by law, in no event will Wandering Stars be liable for personal injury or any incidental, special, indirect or consequential damages whatsoever, including damages for loss of data or progress, arising out of or related to your use of or inability to use the Licensed Application, however caused. Some jurisdictions do not allow the limitation of liability for personal injury or for incidental or consequential damages, so this limitation may not apply to you.
Governing law
This EULA is governed by the laws that apply where Wandering Stars is established, without regard to conflict of law rules, except where mandatory laws of your country of residence provide otherwise.
Third-party beneficiary
You and we acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of its terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
